These Terms of Use govern access to powerankle.site and purchase of AlignSnap digital posture exercise programs offered by Powerankle, Middenweg 65A, 1098 AE Amsterdam, Netherlands. By using the website or buying a program, you agree to these terms. If you do not agree, discontinue use immediately.

1. Definitions

"We," "us," and "our" refer to Powerankle operating AlignSnap. "You" means the visitor, account holder, or customer. "Programs" means digital content packages including mini-exercises for posture throughout the day, guides, audio cues, and related materials delivered electronically. "Platform" means powerankle.site and associated authenticated areas.

2. Eligibility

You must be at least eighteen years old or have legal capacity under Dutch law to enter binding agreements. By creating an account, you confirm that information provided is accurate and that you will keep credentials confidential.

3. Nature of services

AlignSnap provides educational movement content designed for general wellness and desk-break habits. Programs are not a substitute for individualized professional advice. You are responsible for exercising within your comfort and stopping if discomfort occurs. Content describes posture habits and short movement sequences, not regulated health services.

4. Accounts and access

Upon purchase confirmation, we grant a personal, non-exclusive, non-transferable license to access purchased materials for the period stated in the product description. Team licenses permit use by the number of seats purchased. Sharing login credentials beyond permitted seats is prohibited. We may suspend access for breach of these terms or suspected fraud.

5. Orders and pricing

Prices on posture-programs.html are shown in euros and include Dutch VAT where stated. Orders are confirmed after we accept payment and send access instructions. We may correct typographical errors before acceptance. Business customers may request invoices by contacting team@powerankle.site.

6. Payment

Payments are processed through secure third-party providers. You authorize charges for selected programs plus applicable taxes. Failed payments may delay access until resolved.

7. Intellectual property

All text, illustrations, videos, audio, software, and branding on the Platform remain the property of Powerankle or licensors. You may download materials solely for personal or licensed organizational use as permitted. Copying, redistribution, public performance, resale, or creation of derivative commercial products without written consent is forbidden.

8. Acceptable use

You agree not to: reverse engineer the Platform; scrape content at scale; upload malware; harass staff; misrepresent affiliation with AlignSnap; use programs in violation of law; or attempt unauthorized access to other accounts. Violations may result in termination without refund where legally permitted.

9. Availability and changes

We strive for reliable uptime but do not guarantee uninterrupted access. Maintenance, updates, or events beyond our control may cause temporary unavailability. We may update exercises, interfaces, or program structure to improve clarity and safety. Material changes to purchased bundles are communicated to active customers when reasonable.

10. Disclaimer of warranties

Programs and the Platform are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant specific posture outcomes; individual results vary with consistency and workstation setup.

11. Limitation of liability

Nothing in these terms excludes liability that cannot be excluded under Dutch law, including death or personal injury caused by negligence or intentional misconduct. Subject to mandatory law, Powerankle is not liable for indirect, incidental, special, or consequential damages, lost profits, or data loss arising from use of Programs. Our aggregate liability for any claim relating to a specific order is limited to the amount you paid for that order in the twelve months preceding the claim.

12. Indemnity

You agree to indemnify and hold harmless Powerankle from claims arising from your misuse of the Platform, violation of these terms, or infringement of third-party rights, except where caused by our gross negligence or willful misconduct.

13. Consumer rights in the Netherlands

If you are a consumer within the meaning of EU consumer law, you retain statutory rights including withdrawal rights for distance contracts where applicable. Digital content delivered immediately may limit withdrawal once delivery begins with your express consent as described at checkout and in our Return Policy.

14. Termination

You may stop using the Platform at any time. We may terminate or suspend access for breach, legal requirement, or discontinuation of services with notice when practicable. Provisions that by nature should survive termination remain in effect, including intellectual property, disclaimers, and liability limits.

15. Governing law and disputes

These terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent courts in Amsterdam unless mandatory consumer rules require another forum. Consumers may also use EU online dispute resolution platforms.
